Terms & Refund Policy

Plain-language terms for ordering TRAK during the founders pre-order — what you're buying, how billing works, and how cancellations and refunds are handled.
1. About these terms
These terms govern your purchase of TRAK products and the TRAK Pro subscription from TRAK SAS, a company headquartered in Paris, France (“TRAK”, “we”, “us”). By placing an order you agree to them. Questions? Email hello@trak.watch.
2. What you are ordering
TRAK is sold as a founders pre-order. The TRAK Chip is $89 one-time and the Collector’s Trio is $239 one-time (three chips). These are early-allocation reservations of hardware from our founders production batch.
Hardware is charged in full at the time of order to reserve your place in the batch.
3. TRAK Pro subscription
Every chip includes TRAK Pro — the live-tracking, alerts and Recovery Mode membership — at $49 per month, with one subscription per chip.
TRAK Pro is free until your chip ships. Billing does not begin while you are waiting on your hardware: the first monthly charge is deferred until around the founders ship date, so you never pay for tracking before you can use it. You can cancel TRAK Pro at any time, effective at the end of the current billing period.
4. Payment & taxes
Payments are processed by Stripe. We never see or store your full card details. By ordering you authorise the one-time hardware charge now and recurring TRAK Pro charges once billing begins, until you cancel.
Prices are shown in US dollars. Where required, applicable VAT or sales tax is calculated and added at checkout based on your billing address.
5. Shipping & fitting
The founders batch is targeted to ship in Q4 2026. This is an estimate for a pre-production product and may move; we will keep you updated by email and you may cancel for a full hardware refund at any time before your order ships.
TRAK is fitted by a certified watchmaker. Fitting is arranged after your chip ships. TRAK is not responsible for any independent watchmaker’s work, but our concierge will help you find a partner.
6. Cancellations & refunds
Hardware: you may cancel and receive a full refund of the hardware price at any time before your order ships. Once an order has shipped, contact hello@trak.watch and we will work with you in good faith on returns of unfitted, undamaged hardware.
TRAK Pro: cancel anytime; you keep access until the end of the period you have paid for. Because Pro is free until your chip ships, cancelling before then means you are never charged for it.
Consumers in the EU/EEA may have a statutory right of withdrawal within 14 days of receiving goods, subject to legal exceptions. Nothing here limits rights you have under mandatory consumer law.
7. Warranty
TRAK hardware carries a limited warranty against manufacturing defects. It does not cover damage from improper fitting, accident, or misuse. Warranty details are provided with your hardware.
8. Acceptable use
TRAK is intended to help you locate watches you own or are authorised to track. You agree not to use TRAK to track any person or any item without a lawful basis. You are responsible for complying with the laws of your jurisdiction.
9. Privacy
Your data is handled as described in our Privacy Policy. Location data is end-to-end encrypted and visible only to you and the people you invite.
10. Liability
To the maximum extent permitted by law, TRAK is not liable for indirect or consequential losses, including the loss or theft of a watch. TRAK is a recovery aid, not a guarantee of recovery. Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Governing law & changes
These terms are governed by French law, and disputes are subject to the competent courts of Paris, France, without prejudice to mandatory consumer protections in your country of residence.
We may update these terms as the product evolves; material changes will be announced by email and reflected in the date below.
